Update November 5, 2016: Black box inspections

In the coming weeks, large-scale inspections will be carried out, more than there have been in recent months. Pay special attention during the weekend after Horeca Expo, November 25-27, 2016!

If your business is required to comply and does not yet have the "White Cash Register" and the black box, the inspector will immediately issue a EUR 1,500 fine.

The Black box is the certified control unit for cash registers as mandated by Belgian legislation since January 1, 2015, for restaurants and other dining establishments. POSGARD will support businesses subject to this obligation with specially developed certified POS software.

POSGARD has been involved in the working group for cash register systems since the beginning of the process. The registered cash register or fiscal cash register for the hospitality industry (restaurant, brasserie, tearoom, etc.) is also called a black box.

The purchase of the so-called black box:

  • The future lies in POS systems (with Touchscreen, as opposed to the ECR system that has pre-programmed keys), so POSGARD will only deliver touchscreen systems. These smart touchscreen systems are much more flexible, multi-functional, and adaptable to potential future legislative changes. Your staff will also prefer working with touchscreen PCs as they are more accustomed to them and less training is required.
  • The black box on a registered POS system will record all transactions so that an inspector can immediately access all data during an inspection.
  • The black box will be connected to the cash register.
  • POSGARD supplies the various black boxes, which will be compatible with our registers, throughout Belgium.

Please note when purchasing a fiscal cash register: not all POS systems and software qualify!

  • Fines range from EUR 1,500 - 5,000 for non-compliance

WHEN:

1/1/2014: voluntary implementation

1/1/2015: start of mandatory implementation

WHO

  • This applies to an operator of an establishment where meals are regularly consumed, as well as the caterer who regularly provides catering services.
  • Meals:
    • food items with an additional service
    • if a 12% VAT rate applies
    • drinks excluded
    • the concept of "light meals" is being phased out
  • Consumption on-site is not afhaal. Afhaal = open roof, awning, no table service, drinks in packaging
  • Regularly: turnover (excl. VAT) from hospitality activities: EUR 25,000 annually or more consisting of meals for on-site consumption. You therefore calculate all turnover at 12%, excluding afhaal meals and drinks
  • Chippy / bakery: if a dining room is present and on-site consumption exceeds EUR 25,000, a registered cash register system is required for both on-site consumption and afhaal
  • If on-site consumption is less than EUR 25,000: no registered cash register system required, but VAT receipts must be issued, potentially with a cash register for on-site consumption; no VAT receipts required for afhaal.

UPDATE: 29/12/2014

The government today sent letters to the relevant businesses. The use of a GKS (Registered Cash Register System) or Black box register is mandatory from January 1, 2015, for every operator who realizes at least EUR 25,000 of their turnover from on-site meal consumption:

1) The operator applies the EUR 25,000 rule to the previous year's turnover. If the result is EUR 25,000 or more, the GKS/Black box must be installed.

2) These operators must register as mandatory GKS users on the Government website by February 28, 2015, at the latest. Only legal representatives of the company can perform this registration. If you wish to receive the guide, please contact us!

Interesting to know:

  • The moment of registration has no influence on the implementation date – you will find out immediately upon online registration which implementation date applies to you
  • Hospitality businesses that do not fall under the EUR 25,000 rule (such as bars) also receive compensatory measures if they use a GKS!

Request VAT Signing Card (VSC):

The VSC card required to be placed in the Black box can only be requested once you, as an operator, have placed an order for a GKS. You then provide the identification number of the POS system and the black box!
